Brad specialises in commercial law, with a particular emphasis on litigation and arbitration. His focus is on running high value cases to trial (settling along the way if appropriate) and oral and written advocacy.
Although Brad has a broad commercial litigation practice, a significant part of it is insolvency, both personal and corporate. He acts for insolvency practitioners, debtors and creditors. He frequently appears in the applications lists and has experience of a wide range of contentious insolvency matters, particularly claims involving fraud and misfeasance.
Other areas where Brad has particular expertise and experience are insurance litigation (where he has acted with Winston Hunter QC on a number of high value claims relating to refusal of indemnity), professional negligence, particularly claims against solicitors and barristers, and mortgage, finance and banking claims. He acts regularly for large high street banks and building societies and is recommended in the Legal 500 2017 for his expertise in this area as well as for commercial, banking and insolvency.
In addition to frequently appearing in the Business and Property Courts of the High Court, Brad has appeared in the Court of Appeal on a number of occasions. Most recently, he appeared successfully in the Court of Appeal on a test case concerning EU law and extraterritoriality considerations in EC Regulation 261/2004.
Brad is a member of the Attorney General’s regional panel and has acted in matters relating to VAT, Customs and Excise duties and directors’ disqualifications.
